Agreement Overview

This Terms & Conditions / Licensing Agreement ("Agreement") is entered into between the purchaser ("Client", "you") and MotionGreetings.com ("we", "us", "our"). By purchasing or accessing any of our digital greeting cards, you agree to the following terms.

Product Description

MotionGreetings.com provides animated digital greeting cards ("Cards") customized with your company’s logo and message. The base artwork and animation remain the intellectual property of MotionGreetings.com.

License Grant

We grant you a non-exclusive, non-transferable, limited license to use the customized Card for your internal or external communications for a period of one (1) year from the date of purchase.

Usage Restrictions

You may not:

• Resell, sublicense, distribute, or otherwise commercially exploit the Card or any part of it.
• Alter or remove any copyright, watermark, or proprietary notices from the Card.
• Use the Card for unlawful, offensive, or defamatory purposes.

Intellectual Property

All content, including but not limited to the design, animation, and code of the original Card, remains the sole property of MotionGreetings.com. Your license is for usage only and does not transfer ownership of any intellectual property.

Customization

Customization is limited to the message and logo you provide. Any additional changes may require a separate agreement and may incur additional fees.

Termination

We reserve the right to terminate your license without refund if you breach any term of this Agreement. Upon termination, you must cease all use of the Card and destroy all copies.

Refund Policy

Due to the digital and customized nature of our products, all sales are final and non-refundable once customization has begun.

Limitation of Liability

In no event shall MotionGreetings.com be liable for any indirect, incidental, or consequential damages arising out of or related to the use of our Cards.

Governing Law

This Agreement is governed by the laws of the State of New York, without regard to its conflict of law provisions.

Client Responsibilities

The client is responsible for providing all required assets for customization, including a high-resolution company logo—preferably in vector format (e.g., SVG, EPS, or AI). Delays in delivery may result if assets are not provided in a timely or usable format.

Attribution / Branding

MotionGreetings.com reserves the right to include a subtle attribution or watermark on the card unless otherwise requested in writing by the client.

Delivery & File Format

Final digital greeting cards will be delivered via a secure URL, embedded in Vimeo. Clients may also request a high-resolution MP4 file for their records or alternative use. Delivery will occur within a reasonable timeframe following receipt of all required customization materials.
